Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of DraftClick AI (the “Service”), operated by Dunkit K.K. (Dunkit株式会社, “Dunkit”, “we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
DraftClick connects to a mailbox you designate and uses AI to prepare reply drafts for inbound mail. Drafts are placed in the Drafts folder of your own mailbox, written in a style learned from your real sent mail. Three points define how the Service works:
- Drafts only — no sending. The Service holds no send permission for your mailbox and cannot send mail on your behalf. You always review, edit if needed, and send every message yourself.
- Facts guard. Drafts are designed not to invent factual claims such as prices or dates; where a fact is unknown, the draft flags it for your review instead. This is a safeguard, not a guarantee — see Section 7.
- Your review is required. AI-generated text may contain errors. You are responsible for reviewing every draft before sending it.
Feature availability (e.g. number of inboxes, attachment reading, supported mail providers) depends on your plan and may evolve over time.
2. Accounts and eligibility
- You must be at least 18 years old, or of the age of majority in your jurisdiction, and have the legal capacity to enter into these Terms. If you use the Service on behalf of a company, you represent that you are authorized to bind it.
- You may only connect mailboxes that you own or are expressly authorized to manage.
- You are responsible for the accuracy of your registration information and for all activity under your account. Keep your sign-in access secure and notify us promptly of any unauthorized use.
3. Subscriptions, trial and billing
- Paid plans are currently Premium (US$19/month) and Pro (US$39/month), billed monthly per subscription through Stripe.
- 14-day free trial. Starting a trial requires a valid payment card, but nothing is charged during the trial (US$0 today).
- Conversion. Unless you cancel before the trial ends, the trial converts automatically to the paid plan you selected and the first charge is made. We send a reminder email approximately 3 days before the first charge.
- Cancellation. You can cancel at any time from the Stripe billing portal (reachable from your dashboard in 2 clicks). Cancellation takes effect at the end of the current billing period; you keep access until then. Fees already paid are non-refundable except where required by law.
- We may change plan prices or features with reasonable advance notice; changes apply from your next billing period.
4. Acceptable use
You must not:
- use the Service for unlawful purposes, including sending spam, fraudulent, deceptive or harassing mail;
- connect a mailbox without the authority to do so, or process mail content in violation of applicable law or third-party rights;
- attempt to probe, disrupt, reverse engineer, or gain unauthorized access to the Service, or circumvent plan limits or security measures;
- resell or provide the Service to third parties without our written consent.
5. Your content
You retain all rights to your mail content and to the drafts produced for you. You grant us a limited license to access and process your mail content solely to provide and secure the Service. We do not use your mail content to train AI models — ours or our vendors’ (see the Privacy Policy for details).
6. Intellectual property
The Service, including its software, design, and branding, is owned by Dunkit or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you. If you send us feedback, we may use it without restriction or compensation.
7. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. In particular:
- AI-generated drafts may contain errors, omissions, or inappropriate content despite our safeguards. You are solely responsible for reviewing each draft before sending it, and for every message you send.
- We do not warrant that the Service will be uninterrupted, timely, or error-free, or that a draft will be produced for every message.
8. Limitation of liability
To the maximum extent permitted by law, Dunkit is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. Nothing in this section limits liability for damages caused by our willful misconduct or gross negligence, or liability that cannot be limited under applicable law (including, for consumers, the Consumer Contract Act of Japan).
9. Suspension and termination
- You may stop using the Service and delete your account at any time.
- If your account has unpaid fees after the trial or a billing period ends, we may pause drafting and disconnect connected mailboxes until the account returns to good standing.
- We may suspend or terminate your access if you materially breach these Terms, if required by law, or if continued provision would create a security risk. Where practicable we will notify you first.
- Upon termination, your right to use the Service ends and your data is handled as described in the Privacy Policy. Sections that by their nature should survive (5–8, 10, 11) survive termination.
10. Changes to the Service and these Terms
We may modify the Service and these Terms. For material changes we will give reasonable advance notice by email or in the app, indicating the effective date. If you continue using the Service after the effective date, the updated Terms apply. If you do not agree, cancel before the change takes effect.
11. Governing law and jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute arising from or relating to the Service or these Terms.
